I 11.F.b I <br /> RESOLUTION.NO. 2019-1691 <br /> A RESOLUTION OF:THE MAYOR AND COUNCIL OF THE CITY OF PRESCOTT, <br /> YAVAPAI COUNTY, ARIZONA, APPROVING A DEVELOPMENT AGREEMENT WITH <br /> WESTRIDGE PRESERVE LLC. <br /> RECITALS: <br /> WHEREAS, the City of Prescott ("City") requires a water main with increased <br /> capacity in the area of Kile Street; and E <br /> a" <br /> WHEREAS, Westridge Preserve LLC. ('Westridge") is currently undertaking a <br /> construction in the same area 'and will benefit from the water main with increased <br /> capacity; and <br /> WHEREAS,the City and Westridge wish to enter into an agreement to complete <br /> the construction and delineate the rights and obligations of both parties. c <br /> ENACTMENTS: <br /> NOW, THEREFORE, BE IT RESOLVED BY THECOUNCIL OF THE CITY OF . r� <br /> PRESCOTT AS FOLLOWS: N <br /> Section 1 THAT, the City of Prescott hereby approves and adopts the Kile <br /> Street Water Main Development Agreement with Westridge, City Contract No. 2019-226 , ' a, <br /> as set forth in Exhibit"A"which is attached and made a part hereof.
