I 8.11 I <br /> • <br /> CITYor PRESCOTT <br /> �,�✓�Jk°rytw°� COUNCIL AGENDA MEMO <br /> MEETING DATE/TYPE: VOTING MEETING 5-14-19 <br /> DEPARTMENT: City Attorney <br /> AGENDA ITEM: Adoption of Resolution No. 2019-1693 approving the use of eminent <br /> domain to acquire property necessary for improvements to the Government Canyon <br /> Bridge. <br /> I Approved By: Michael Lamar, City Manager <br /> Item Summary <br /> Approval of this item would authorize the City Legal Department to commence an <br /> Eminent Domain action to acquire property necessary for an important public project. <br /> Background <br /> The City of Prescott is working on a project to replace the existing Government Canyon <br /> Bridge on Butterfield Road. The Bridge is adjacent to and east of property belonging to <br /> the Cactus Mobile Ranch Home Community LLC. As part of the engineering design it <br /> was determined that the City requires a slope and drainage easement from Cactus <br /> Mobil Ranch Home Community LLC. Despite repeated attempts to reach a mutually <br /> acceptable purchase price, the owner of Cactus Mobile Ranch Home Community LLC <br /> refuses to grant the easements to the City. As a result it is necessary for the City to use <br /> its power of Eminent Domain to acquire the easements. <br /> The total size of the easements is 5,213 square feet and an appraisal conducted by the <br /> City has determined the property is worth a total value of$6,300.00. <br /> Attachments <br /> 1.
