I 8.J.a I <br /> City Manager's choosing for City Manager's participation in said supplementary <br /> retirement plan. The payment into such designated plan on the City Manager's <br /> behalf will be in equal proportionate amounts each pay period. <br /> SECTION 5. SEVERENCE PAY <br /> In the event that the City Manager is removed from office by the Council of <br /> the City of Prescott, the City Manager shall be entitled to severance pay as set <br /> forth below. Severance pay shall mean the gross monthly salary as set from d <br /> time to time between the parties. In the event that the City Manager is removed o <br /> during the term of this Agreement, or any time thereafter, then the City Manager E <br /> shall be entitled to six (6) months severance pay. Should the City Manager resign w <br /> under this Agreement, the City Council shall have no obligation to pay severance L <br /> to the City Manager, but may, at its discretion, determine whether or not o <br /> severance pay will be paid to the City Manager. The City shall not be obligated 0 <br /> for severance hereunder in the event that the cause for removal shall be wL <br /> felonious conduct while in office, or in the event that the City Manager shall not 0 <br /> have given a minimum of sixty (60) days notice of his resignation. <br /> V <br /> c <br /> SECTION 6. REMOVAL OF CITY MANAGER o <br /> To <br /> > <br /> This Agreement may be terminated by the City, acting through the City ° <br /> Council. In accordance with Article III of the Charter of the City of Prescott, the a <br /> City Manager serves at the pleasure of the City Council, and no notice or cause <br /> shall be required for his termination. <br /> SECTION 7. SALARY AND BENEFIT ADJUSTMENTS <br /> V <br /> to <br /> tr <br /> Following the annual evaluation of the City Manager by the City Council, a <br /> the salary and any additional benefits of the City Manager may be adjusted by <br /> the City Council. Section 3 of this Agreement shall be deemed to be so <br /> amended by formal recorded vote of the City Council.
