ORDINANCE NO. 4917-1455 PAGE 2 <br /> When installed, said device shall be used to determine the flow of wastewater for that <br /> user group, and shall be the basis for the billing charge. Flow-based billing shall be <br /> calculated as the sum of the monthly base charge per account plus an amount per unit <br /> of flow, both as set forth in the Nonresidential (General) category of the Wastewater Fee <br /> Table of Section 2-1-21(B). <br /> (D) The monthly service charge and any other fees herein established shall be <br /> collected from the property owner, or from the users of the premises which are <br /> connected to the city wastewater system. Such monthly service charge and any other <br /> fees established by this Section shall run with the land to which such charges and fees <br /> relate, except where otherwise explicitly prohibited by state law. <br /> (E) All fees and assessments under this Section are due and payable on the date billed. <br /> Late charges of one and one-half percent (1.5%) per month of the unpaid balance due <br /> will be imposed on bills not paid within thirty (30) calendar days after the billing date. <br /> (F) Procedure and remedies for failure to timely pay monthly wastewater only service <br /> charge. <br /> 1. A monthly wastewater-only service charge for wastewater collection and <br /> treatment shall be delinquent if not paid within thirty (30) calendar days after <br /> the bill is issued. <br /> 2. A notice of delinquency shall be mailed certified, return receipt requested, to <br /> the last known address of the property owner or to the address at which the <br /> tax bill for the property was last mailed, and the occupant of the premises or <br /> other users of the city wastewater system. <br /> 3. An appeal to the notice of delinquency must be filed in writing within fifteen <br /> (15) calendar days of the date of receipt of the notice. <br /> (G) Notwithstanding any term, clause or section in this chapter, pursuant to A.R.S. <br /> Section 9-511.02, in the event the monthly wastewater-only service charge for <br /> wastewater collection and treatment for a property becomes delinquent for more than <br /> ninety (90) days, the city may file a lien upon the property for which wastewater service <br /> is provided for such nonpayment of monthly charges. Prior to filing such lien, the city <br /> shall comply with the procedures set forth in A.R.S. Section 9-511.02. Any lien placed <br /> on a property pursuant to this section shall be enforceable pursuant to and in <br /> accordance with A.R.S. Section 9-511.02. <br /> (H) There is hereby established a septage receiving rate for wastewater haulers as <br /> such use is described in Section 2-1-46-3 of this Code. The septage receiving rate for <br /> wastewater haulers shall be determined based on a rate of One Hundred Dollars <br /> ($100.00) for every One Thousand (1000) gallons of septage delivered. <br /> SECTION 3. THAT the Prescott City Code Title II, Chapter 2-1, Section 2-1-57 (Effluent <br /> Lines and Connections) is amended by adding the following: <br /> 2 <br />
