Manager will be unclassified, "FLSA-exempt" positions. Staff shall be <br /> appointed by the MPO Administrator consistent with the City of Prescott's <br /> hiring process; the MPO Administrator shall supervise the Program Manager <br /> and additional staff, including appraising their performance and <br /> recommending personnel actions. The employment of all said personnel shall <br /> be in full conformance with the City Code of Prescott, and the City of <br /> Prescott's employee handbook, personnel rules and all other applicable City <br /> of Prescott rules, procedures and ordinances governing its unclassified and <br /> classified employees. The City shall solely maintain the personnel file for <br /> each such on-loan employee. The MPO Administrator will serve at a level <br /> equivalent to a department head position of the City of Prescott reporting to <br /> the City Manager or his/her designee. Because of the close working <br /> relationship and familiarity of CYMPO with the performance of said City on- <br /> loan employees, CYMPO shall prepare a draft annual evaluation of the MPO <br /> Administrator, forward it to the City, and recommend personnel actions for <br /> consideration by the City, including compensation adjustments pursuant to <br /> the Pay-for-Performance and other compensation policies of the City, <br /> whenever CYMPO deems such actions are appropriate. Should CYMPO for <br /> whatever reason determine it is appropriate to sever its employment <br /> relationship with the MPO Administrator, or other staff positions, it shall <br /> forward its recommendation to Prescott that such positions are no longer <br /> needed. In such event, the elimination of the positions for reasons not related <br /> to performance shall be treated as a layoff under the City of Prescott's <br /> personnel rules and procedures. In the event that CYMPO shall recommend <br /> termination, suspension, demotion or other disciplinary action(s), it shall <br /> forward its recommendation, along with pertinent facts, reports and/or <br /> investigations, to the City of Prescott. The City shall thereafter review the <br /> recommendations and take such appropriate action as may be warranted under <br /> its rules and procedures. In the event CYMPO desires to employ additional <br /> personnel through Prescott, amendment of this MOU by the parties shall be <br /> required. <br /> (C) Prescott will employ said employees in the same manner as its <br /> other employees including, but not limited to, health and other insurance <br /> coverages, leave accrual, and Arizona State Retirement System participation. <br /> (D) During the term of this MOU, Prescott agrees not to discharge any <br /> or all of the MPO Administrator or other staff unilaterally, for any reason, <br /> including a lack of funding from CYMPO to support personnel costs, without <br /> 2 <br />
