Adoption of Ordinance No. 4558 -An ordinance of the Mayor <br /> and Council of the City of Prescott, Yavapai County, Arizona, <br /> authorizing the purchase of easements and right-of-way from <br /> the Prescott Unified School District for the Ruth Street <br /> Improvement Project and authorizing the Mayor and staff to <br /> execute any and all documents to effectuate said purchase. <br /> Engineering Services Director Nietupski explained as part of the <br /> reconstruction of Ruth Street improvements at the intersection of <br /> Whetstine Avenue, Ruth Street and Demerse Avenue acquisition was <br /> required of two triangular parcels of property for public right-of-way from <br /> the Prescott Unified School District; the Agreement for Sale provided <br /> compensation in the amount of $7,910.00 and limited drainage, paving, <br /> driveway, and fencing improvements to accommodate school bus access <br /> from Whetstine Avenue to the high school; the School District approved <br /> the sale of the parcels at their meeting of August 22;the funding was from <br /> the 1-cent sale tax. <br /> O. Adoption of Ordinance No. 4559 - An ordinance of the Mayor <br /> and Council of the City of Prescott, Yavapai County, Arizona, <br /> disclaiming any title interest in real property known as Yavapai <br /> County Parcel No. 109-08-088 and authorizing the Mayor and <br /> staff to execute all necessary documents to disclaim such <br /> interest. <br /> Attorney Gary Kidd explained Frank Castro filed action on a lot next to his <br /> lot;the County and City were listed on the title report as having a possible <br /> interest;by disclaiming that interest the City could stay out of the lawsuit. <br /> P. Adoption of Ordinance No. 4560—An ordinance of the Mayor <br /> and Council of the City of Prescott, Yavapai County, Arizona, <br /> authorizing the sale of property located northeast of Lot 2 in <br /> the Golf Links Subdivision. <br /> Golf Manager Paul Parker explained the property was adjacent to Lot 2 <br /> and next to the cart path and was between a fence and the path; one <br /> proposal was submitted by the property owner of Lot 2,Andrew Ozols, in <br /> the amount of$2,500.00; the fence would be moved to the edge of the <br /> concrete cart path and would have a wall on each side. <br /> Councilman Blair asked why this was being sold, and Mr. Parker said it <br /> would eliminate the maintenance of the property;there was no irrigation in <br /> the area and was a challenge to maintain and staff would no longer have <br /> to clean up the area. <br /> err <br />
