COUNCIL AGENDA MEMO — October 23, 2012 <br /> DEPARTMENT: Public Works <br /> AGENDA ITEM: Adoption of Ordinance No. 4842-1240 granting an Electric Utility <br /> Easement to Arizona Public Service Company <br /> Approved By: <br /> Date: <br /> Department Head: Mark Nietupski 10/08/2012 <br /> Finance Director: Mark Woodfill <br /> City Manager: Craig McConnell .C/! /O-8-'2. <br /> ( <br /> Item Summary <br /> Approval of this item will grant an Electric Utility Easement (EUE) to Arizona Public <br /> Service Company (APS) across City owned real property (The Shops at Prescott <br /> Gateway) near the intersection of State Route 69 and Lee Boulevard to extend service <br /> to new commercial buildings at the site. <br /> Background <br /> APS has an existing underground utility easement to provide service to new structures, <br /> as recorded in Book 4843, Page 431 and shown on the attached Area Map. APS is <br /> requesting the EUE, eight feet (8 feet) wide for Pads "A", "B" and "C" to complete <br /> service to three buildings currently under construction. <br /> The EUE and Ordinance are required because City owned properties are not covered <br /> under the APS Franchise Agreement. <br /> APS will pay all recording fees. <br /> Attachments - Area Map <br /> - Utility Easement <br /> - Exhibit "A" - Legal Description of Easement Premises <br /> - Ordinance <br /> Recommended Action: MOVE to adopt Ordinance No. 4842-1240 <br /> 1 <br />
