9.0 <br />( vol, PRESCOTT <br />MEETING DATE/TYPE: <br />COUNCIL AGENDA MEMO <br />VOTING MEETING 8-14-18 <br />DEPARTMENT: Public Works <br />AGENDA ITEM: Award of City Contract No. 2019-070 for Bureau of Land Management <br />Reimbursement Agreement for Application AZA 036972, as part of the Deep Well <br />Ranch / Pioneer Parkway Extension. <br />FUNDING SOURCE: Private Contributions <br />Approved By: Michael Lamar, City Manager <br />Item Summary <br />Approval of this Cost Reimbursement Agreement will authorize the expenditure of City <br />funds to acquire right-of-way from the Bureau of Land Management (BLM), for access <br />to Deep Well Ranch lands north of Pioneer Parkway, which have been newly annexed <br />into the City of Prescott, as well as to lands currently leased to the City of Prescott for <br />City of Prescott Pioneer Park. <br />Background <br />Currently there is no roadway access to the Deep Well Ranch lands between Pinon <br />Oaks and Long View Estates subdivisions. The most reasonable access would be from <br />Pioneer Parkway and across BLM land. As Pioneer Parkway is designated as a limited <br />access roadway, the only designated intersection to this land area would be at the <br />Pioneer Parkway and Commerce Drive intersection. <br />Per the Development Agreement (DA) with Deep Well Ranch (City Contract No. 2018- <br />115), Section 3.2(b), states, "The City, as necessary to implement the Infrastructure <br />Plan, shall cooperate reasonably with. (b) an Owner's request for the City to be the <br />applicant with appropriate governmental entities regarding the abandonment or <br />acquisition of public rights -of -way or easements necessary to develop the Property". <br />As a result, Chamberlain Development has requested the City be the applicant to the <br />BLM on acquiring right-of-way across the BLM land to the Deep Well Ranch property. <br />The Public Works Department is therefore ready to proceed forward, to make <br />application to the BLM for acquisition of the right-of-way necessary across BLM lands <br />on behalf of the developer. <br />By a separate agreement between the City and Chamberlain Development (Attachment <br />Packet Pg. 117 <br />
